Status of UK dependencies

For the purposes of CE directives the status of the Channel Islands and the Isle of Man are the same. The islands are not part of the UK, but are part of the British Isles as all are designated as Crown dependents. They are not full members of the EU, but Associate Members under Protocol 3 of the UK Treaty of Accession to the EU (part of the Economic Community Act 1972).

Associate Member status means that they are bound to allow free movement of trade and of people across their borders but are not bound by European legislation in other areas. They are not required to implement any of the European New Approach Directives and have no regulations connected with them. Obviously, therefore, products sold in these territories do not require CE marking. It also follows that for the purpose of Authorised Representatives, these territories are not deemed to form part of the EU.

For the purposes of exemption from the Recreational Craft Directive for second hand craft, the waters of any dependent state of an EU member state country are considered to be EU waters.
